Unfortunately not all people plan properly.  At Fendrick & Morgan, LLC, we can assist you if a dispute arises in the administration of an Estate.  Ensuring the proper distribution of an Estate is a complex and, often, lengthy process.  Often there are disagreements surrounding the distribution of an Estate or the intentions of the decedent.  When litigation, or the threat of litigation, occurs during the administration of an Estate, Doug and Jamie can work to protect your interests as a beneficiary or an Executor.

Similarly, in the Trust context, the Trustee of a Trust owes the beneficiaries of that Trust certain fiduciary duties, including a duty to act honestly, prudently and loyally.  When a Trustee violates one of those duties, a bequest may be put in jeopardy.  We can assist beneficiaries and Trustees alike handle issues, such as failure to make proper and timely distributions or improper investments.  In addition, we can assist in the reformation of a Trust where amendments are necessary in order to carry out the settlor’s original intention in establishing a Trust.
